Regulatory Information

A comprehensive set of state and federal laws and regulations govern the design, construction, operation and maintenance of liquid petroleum pipelines. Enbridge bases the design, construction, operation and maintenance of its facilities to comply or exceed these standards, working with state and federal agencies. There are several acronyms used in this section, click here to view the Regulatory Acronym Glossary.

Minnesota Public Utilities Commission
The Minnesota Public Utilities Commission (MPUC) is responsible for certifying project need and pipeline routing in Minnesota.

October 24, 2014 Enbridge files its Notice Plan with the MPUC
December 2014 Enbridge conducts seven Open House (on Dec. 3,4,10,11) meetings along the proposed route*
*Not required under Minnesota Statute
January 27, 2015 MPUC approves Notice Plan
April 24, 2015 Enbridge files its Certificate of Need (CN) and Route Permit (RP) applications with MPUC
July 1, 2015 MPUC deems the CN and RP applications complete, and therefore commences its regulatory approval processes in both applications
August 11-27, 2015
MPUC and Minnesota Department of Commerce (MDOC) hold public information and environmental analysis scoping meetings along the existing and proposed route
January 11, 2016 MPUC order refers joint CN and RP proceedings to Office of Administrative Hearings (OAH) for an administrative law judge to commence contested case proceedings; orders Environmental Impact Statement (EIS) for project; further orders the completion of the EIS before commencing the CN and RP permitting processes.
February 5, 2016 Enbridge files petition for reconsideration with the MPUC, asking it to reconsider its decision to require the final EIS be issued prior to commencing the CN and RP permitting processes
April 25 to May 11, 2016 The MDOC hosts 12 EAW/EIS Public Scoping meetings
October 28, 2016 MPUC adopts a final EIS scoping document
June 28, 2018 MPUC approves the Line 3 Replacement Project, granting a Certificate of Need and approving Enbridge’s preferred route with minor modifications and certain conditions
